  领导干部交流回避制度 领导干部交流回避制度

  第一条 为了培养锻炼干部,优化领导班子结构,推进和加强党风廉政建设,根据《党政领导干部选拔任用工作条例》和《深化干部人事制度改革纲要》有关规定,结合我州实际,制定本制度。

  第二条 干部交流是指领导干部按照组织决定,在县、市(工、行委)之间、部门之间、上下级机关之间、党政机关与企事业单位及社会团体之间进行的调动或者挂职锻炼。

  第三条 干部交流工作应坚持民主集中制的原则、依法办事的原则、培养锻炼干部与改善领导班子结构相结合的原则。

  第四条 以下人员为重点交流对象:

  (一)县、市、工、行委党委、政府领导成员、纪检监察、审判、检察机关和组织、人事、公安、财政、审计部门主要负责人;

  (二)州级部门领导成员,州级有关部门重要业务处室主要负责人;州级部门内设机构中人事、财务及其他需要交流的科室主要负责人。

  第五条 干部交流的主要类型:

  (一)培养型交流

  1、拟提拔担任县(处)级党政领导职务但没有两年以上基层工作经历的干部,必须有计划地交流到基层工作两年以上。

  2、拟提拔担任县(处)级党政领导职务但没有在下一级两个以上职位任职经历的干部,在同级职位之间进行交流。

  3、州级部门和县、市党政领导班子后备干部,要有计划地安排到艰苦地区、压滤机滤布厂家关键岗位任职或者挂职锻炼。

  (二)回避型交流

  1、县、市(工、行委)党政领导班子正职,以及纪检监察、审判、检察机关和组织、人事、公安、财政、审计等部门的正职,一般不得由本地籍或本地出生、生长的干部担任。已在其原籍、出生地、生长地所在县、市(工、行委)任职满一届的党政领导班子和上述部门正职领导干部,必须易地或者在部门之间交流。

  2、有夫妻关系、直系血亲关系、三代以内旁系血亲关系以及近姻亲等亲属关系,双方在同一领导班子里任职,或者在同一机关担任直接隶属于同一领导人员的职务,或者有直接上下级领导关系职务的,其中一方必须交流。

  (三)任职期满交流

  1、县、市(工、行委)党委、政府领导成员在同一职位上任职满10年的,必须交流。

  2、州直各部门和县、市(工、行委)部门领导干部,在同一职位上任职满10年的,必须交流。

  3、州级人事、公安、财政、审计等部门的主要负责人,县、市(工、行委)纪检监察、审判、检察机关和组织、人事、公安、财政、审计等部门的主要负责人,在同一领导岗位任职满10年的,必须交流。

  4、州级经济部门、政府部门、行政执法监督部门重要业务处(科)室主要负责人,州级部门内设机构中的纪检、人事、财务等科室主要负责人,在同一职位任职满5年的,应在部门内部或者部门之间进行轮岗交流。

  (四)调整性交流

  班子成员年龄、知识和专业结构不合理,或者班子内部不团结、严重影响工作,以及其他原因需要调整的,应进行交流。

  第六条 有下列情况之一的,一般不进行交流:

  (一)县、市(工、行委)党政领导干部年龄超过50周岁的;

  (二)州级部门领导干部年龄超过55周岁的;

  (三)因健康原因影响正常工作的;

  (四)经考核、考察被确定为不称职的;

  (五)因涉嫌违纪违法正在接受组织审查而尚未作出结论的;

  (六)县、市(工、行委)党委、政府领导干部,除提拔任职、降职以及因年龄、健康原因需交流调整外,正职领导干部任期未满一届、其他领导干部任职不满3年的;

  (七)其他原因不适合交流的。

  第七条 干部交流工作,由各级党委(党组)及组织(人事)部门按照干部管理权限组织实施。州委管理的领导干部,主要在全州范围内交流;县、市(工、行委)党委管理的干部,主要在本地范围内交流。

  第八条 干部交流按照下列程序进行:

  (一)组织(人事)部门拟定干部交流工作方案;

  (二)组织(人事)部门征求干部调出、调入单位意见,研究提出交流人选,必要时可听取本人意见;

  (三)党委(党组)集体讨论决定,组织(人事)部门办理调动等有关手续;

  (四)党委(党组)或组织(人事)部门负责与被交流干部谈话,做好思想工作;

  (五)被交流干部移交工作,按规定时间到新单位报到,并将行政关系、工资关系、组织关系等转入新单位。

  第九条 需要按法定程序选举或任免的干部,交流时其任免职应按照法定程序办理。按有关规定应实行离任审计的,由审计部门进行审计。

  第十条 干部交流一般在领导班子换届或者届中调整时,有计划地集中进行。为保证领导班子的相对稳定,每次交流干部的数量,一般不应超过领导班子成员的三分之一。同一地区或者部门的党政正职一般不同时易地交流。

  第十一条 干部交流应严格执行领导班子职数的有关规定,不得超职数配备。

  第十二条 干部交流应严格执行以下纪律:

  (一)任何地区和单位必须坚决执行上级关于干部交流的决定,干部必须服从组织作出的交流安排。

  (二)各级党组织集体研究决定交流对象,不准个人或者少数人指定交流对象,不准借干部交流突击提拔干部,不准借干部交流排斥异己,拉帮结派。

  (三)干部调离后,不准干预原地区或者单位的工作,不准从原单位随带工作人员和携带交通、通讯工具及其他公共物品。

  对违反上述干部交流纪律的当事人和责任者,根据《中国共产党纪律处分条例(试行)》、《关于对违反(党政领导干部选拔任用工作暂行条例)行为的处理规定》及其他有关规定,视情节轻重予以处理。

  第十三条 在干部交流工作中,采取以下配套措施:

  (一)对交流到基层和艰苦地区工作并取得突出成绩的干部,应优先提拔使用;

  (二)凡上挂、外派、下派挂职锻练的干部,在锻练期间,原工资福利待遇不变;

  (三)被交流的干部,其配偶子女是否随调、随迁,可尊重干部本人意愿。

  第十四条 干部回避是指为防止领导干部利用职权徇私舞弊而对其任职和执行公务等方面所作的适当限制。

  第十五条 领导干部有下列亲属关系之一的,必须按规定实行任职回避和公务回避:

  (一)夫妻关系;

  (二)直系血亲关系,包括祖父母、外祖父母、父母、子女、孙子女、外孙子女;

  (三)三代以内旁系血亲关系,包括伯叔姑舅姨、兄弟姐妹、堂兄弟姐妹、表兄弟姐妹、侄子女、甥子女;

  (四)近姻亲关系,包括配偶的父母、配偶的兄弟姐妹及其配偶、子女的配偶及子女配偶的父母、三代以内旁系血亲的配偶。

  除尘滤布第十六条 领导干部凡有第十五条所列亲属关系的,不得在同一机关担任双方直接隶属于同一领导的职务或有直接上下级领导关系的职务,也不得在其中一方担任领导的机关从事监察、审计、人事、财务工作。

  同一领导,包括同一级领导班子成员;直接上下级领导关系,包括上一级正副职与下一级正副职之间的领导关系。

  第十七条 领导干部回避的种类包括职务回避和公务回避。

  所谓职务回避,是指对有某种亲情关系的干部,在其担任某些关系比较密切的职务方面作出的限制。

  所谓公务回避,是指领导干部在执行公务时,凡处理涉及本人或与本人有某种亲属关系人员的问题时,都应予以回避。

  第十八条 领导干部任职回避按以下程序进行:

  (一)本人提出回避申请或者任免机关提出回避要求;

  (二)按管理权限进行审核,需要回避的,予以调整。职务不同的,一般由职务较低一方回避;职务相同的,由任免机关根据工作需要和实际情况决定其中一方回避。

  在本部门内无法调整的,与其它部门协商调整;与其它部门协商调整确有困难的,由上级主管部门协调解决。

  第十九条 管理机关或主管部门对原已形成的应回避的关系,应当制定计划,逐步调整;对因婚姻、职务变化等新形成的应回避关系,应当及时调整。

  第二十条 领导干部从事监察、审计、仲裁、案件审理、税费稽征、项目资金审批、出国审批、人事考核、任免、奖惩、录用、调配等公务活动,涉及本人或者与本人有第十五条所列亲属关系人员的利害关系时,必须回避,不得参加有关调查、讨论、审核、决定,也不得以任何方式施加影响。

  第二十一条 领导干部公务回避按以下程序进行:

  (一)当事人提出回避申请,或主管领导提出回避要求;

  (二)本部门进行审核并作出是否回避的决定;

  (三)需要回避的由本部门调整公务安排;

  特殊情况下,可由主管领导直接作出回避决定。

  第二十二条 领导干部在办理任职手续时,应当如实向主管部门报告应回避的亲属关系。对隐瞒不报的,予以批评教育并调整工作。应回避的领导干部,无正当理由拒不服从组织安排的,应采取行政措施予以调整。

  第二十三条 领导干部从事公务活动时,应主动报告应回避的关系。对隐瞒不报的,予以批评教育,其中因未回避给公务造成损失或者造成恶劣影响的,应给予相应处分。

  第二十四条 党委组织部门和政府人事部门负责领导干部回避工作的监督检查。

  第二十五条 本制度由海西州委组织部负责解释。

  第二十六条 本制度自印发之日起实行。
