　机关办公用房管理的实施方案

　区级机关办公用房是区人民政府行政资产的重要组成部分，是各部门工作正常运转的基本条件。长期以来，由于办公用房由各部门、各单位分散规划建设和部分产权由各部门所有的管理体制，从而造成了建设标准不统一、部门之间差别较大、房产余缺难以调剂、建设和管理成本费用较高等问题。为适应社会主义市场经济发展和机构改革的要求，更好地为各部门、各单位服务，摸清行政资产的“家底”，逐步对区级机关的公共资源进行再分配，使办公用房的配置日趋合理，改变办公用房苦乐不均的状况。必须改进和加强区级机关办公用房管理，建立所有权与使用权分离，统筹规划，统一建设，统一维修标准，统一调配，资源共享的新管理模式。

　目前我区的机关办公用房现状：一是产权归属不清，经初步摸底，42家机关单位办公用房产权较明晰的有39家，产权不明的有2家，产权未转定的有1家，且房产证与土地证双证不全。二是各部门单位办公用房使用现状和需求及人员编制三者之间的比例失调。三是各部门单位办公用房由于建设和装修标准不一，造成“贫”、“富”差别较大。四是各部门单位办公用房在管理成本上，由于各自为整，看“钱”办事，造成维修、养护成本高等状况。

　针对上述现状和问题经过认真分析和研究提出如下意见：

　一、统一办公用房的房地产权属管理

　区级机关办公用房及其相应土地实行权属统一管理，由区机关事务管理局（以下简称事务局）负责。房产证、土地证统一归事务局管理。

　事务局统一申办机关办公用房所有权及相应土地使用权登记。登记范围包括：党政机关、各部委办局、人民法院、人民检察院以及行政经费和基本建设计划管理关系在政府系统的人民团体占有、使用并在法律上可以确认属于政府机关资产的办公用房及其相应的土地。

　各部门、各单位享有办公用房的使用权，并与事务局登记办公用房使用协议、领取使用证。各部门、各单位负责制定办公用房管理制度，建立健全办公用房使用档案，在核定的办公用房内自主安排，合理使用。

　未经事务局同意，各部门、各单位不得自行处置其使用的办公用房及相应土地，不得改变办公用房的用途，不得将办公用房租、借或调整给下属单位或其他单位使用。

　二、严格办公用房的建设管理

　办公用房的建设管理要继续按照中共中央、国务院《关于党政机关厉行节约制止奢侈浪费行为的若干规定》（中发[1997]13号）的要求，从严控制，因增设机构，调整职能或业务发展需要增加办公用房的，应首先从现有办公用房中调剂解决；确需新建、翻建的，应纳入办公用房建设整体规划，统筹安排，分步实施。

　事务局负责区级机关办公用房的统一规划和建设。根据区总体规划和各部门、各单位办公用房的现状及使用需求，按照合理布局、完善功能，统筹兼顾的原则，编制区级机关办公用房建设整规划和建设用地规划，没有列入规划的项目不能建设。在整体规划的指导下，各部门、各单位可根据自身的实际情况提出本部门办公区的建设规划，拟定规划时要注意改善基础设施，美化环境和长远发展。

　事务局负责机关办公用房基本建设投资管理，统筹安排建设项目，编制年度基本建设投资计划，编报预算，集中支付建设资金。新建、扩建、翻建、改建办公用房，要按照基本建设审批权限并认真执行国家计委颁布的办公用房建设标准，严格履行基本建设审批程序，依法进行公开招投标。各部门、各单位应积极协助建设项目的规划设计、概算编报、施工监督等工作。

　三、建立办公用房的统一调配工作

　对办公用房要实行动态管理，根据办公用房区域环境的变化，适时调整、置换和淘汰不适合机关办公的房屋，不断优化办公用房资源，为党政机关办公提供有力的保障。

　四、办公用房的维修管理

　区级机关办公用房的维修，应坚持一切从简，量力而行的原则，注重维护和完善房屋使用功能，严格控制装修标准，不得变相进行改扩建。

　事务局负责制定办公用房维修管理办法，规定房屋修缮、设备设施改建的标准和要求及日常维修养护的经费标准以及维修项目管理的程序和办法。

　各部门、各单位负责办公用房的日常维修养护，根据规定的经费标准和核定的面积编经费预算，向区财政提出申请。经批准后，列入部门预算并负责组织实施。

　维修工程应实行公开招标，事务局加强对工程的监督，确保工程质量。

　五、开展办公用房的普查和清理工作

　开展区级机关办公用房及相应土地的普查，重点查清办公用房及土地的，权属登记状况、使用管理情况和办公用房及附属设施质量情况，建立办公用房的管理档案。

　对办公用房及土地的使用状况、资产状况要定期进行评估，为制定办公用房的调整方案和维护改造计划提供依据。

　对企事业单位占用机关办公用房的情况，要进行全面清理，并结合机构改革的要求区别不同情况分类处理。事业单位占用机关办公用房，应根据其工作职责和经费与管理部门签订使用或租赁协议，区别不同情况确定租金标准。企业单位占用机关办公用房，原则上应进行清退，清退有困难的，经批准可继续使用，但应按市场价交纳租金。取得的租金收入，各部门、各单位要严格遵循“收支两条线”的原则，纳入预算管理。

　六、制定有关配套措施和办法

　改进和加强区级机关办公用房管理，必须和完善各项管理制度，事务局要根据调查摸底的情况，会同有关部门，研究制定相关配套办法，逐步把办公用房管理纳入规范化、制度化的轨道。各部门、各单位要认真贯彻落实办公用房的各项管理制度，切实加强办公用房的管理，提高办公用房的管理水平和使用效益。

　七、建立区级机关办公用房工作领导小组

　为了切实做好区级机关办公用房清理工作，成立由区政府领导任组长，区纪委、区委办公室、区政府办公室、区财政局、区人事局、区国土资源局、区规划分局、区房管处、区机关事务管理局等单位领导组成的“区级机关办公用房工作领导小组”。

　领导小组下设办公室，办公室主任由事务局局长兼任，办公地点设在区机关事务管理局。

　改进和加强区级机关办公用房的管理，可以促进办公用房资源的优化配置和国有资产的公平利用，促进财政经费的合理利用和有效节约，加强党风廉政建设和机关作风建设，塑造良好的机关形象。
