做好复议应诉工作树立法治政府形象【行政复议工作经验】

　近几年来，兰州市七里河区政府共收到行政复议申请16件，立案受理15件。经过审理，维持原具体行政行为5件，占受理案件总数的38%；撤销、变更6件，占受案总数的46%；申请人撤回复议申请2件；区政府责令七里河区西湖街道办事处和崔家崖乡政府限期重新做出行政处理决定2件；终止复议2件；移送处理1件。复议范围涉及土地、城管、民政、计生等6个部分、3个乡镇和1个街道。行政复议事项包括行政处罚、行政收费、土地征用、土地确权、计生罚款、抚恤金发放以及行政不作为等行政治理的诸多领域。

　　应诉方面，截止目前，区政府法制办受区政府委托共参加应诉案件1起。经过努力，胜诉9起；原告撤诉5起；现待审1起。

　　其中1起在全国最高人民法院结案，4起在甘肃省高级人民法院结案，并均以胜诉结案。诉讼事项既有对区政府做出的行政复议决定不服而引起的行政诉讼案件，也有多年来区政府签订的合同、协议等引发的民事纠纷案件。

　　他们的具体做法是：

　　1、加大宣传，进步熟悉

　　区政府加大宣传力度，尽量拓宽宣传渠道，充分利用会议宣传、培训宣传、上街宣传、简报宣传、投稿宣传以及网络宣传等“六宣传’’的方式，使《行政诉讼法》和《行政复议法》深进人心，营造人人关心和支持行政复议工作的良好氛围。并在具体宣传中把握“三个并重”，即：以宣传复议诉讼知识为主与以案说法为主并重；以向群众宣传为主与以向领导干部宣传为主并重；以向行政机关宣传为主与以向社会宣传为主并重。通过宣传，让广大群众深进地了解行政复议制度，进步行政复议的意识，并能运用行政复议手段维护自己的正当权益，切实解决行政治理相对人“不知道告，不会告”的题目；要让广大机关干部尤其是领导干部熟悉到行政复议是“民心工程”，是打造“诚信政府’’的客观要求，搞好行政复议应诉工作，是贯彻落实十六大精神，实践“三个代表”重要思想的体现，从而将认真做好行政复议应诉工作化为自觉行动。

　　2、强化业务，依法办案

　　为了建设一支政治强、业务精、作风硬的复议应诉工作队伍，除日常抓紧法律法规业务学习外，区政府还安排法制部分领导往昆明、安徽等地考察学习，加强交流，开阔视野。法制办也先后安排法制工作职员参加省、市政府组织的行政执法职员业务培训，甘肃省行政处罚听证主持人培训，兰州市法制研讨班以及兰州市首届知识产权执法骨干培训等工作；并结合每年的行政执法职员换证业务培训工作，法制办工作职员既是组织者，又是受训者，始终坚持认真听课，全面进步业务素质。另外，法制办还自行组织法制专干旁听区法院行政案件的审理，通过旁听，使复议办案职员熟悉庭审程序，把握答辩技巧，增强应变能力，提升应诉水平，切实进步行政复议应诉工作队伍的整体素质。在抓好法制工作软件的同时，区政府还抓好法制办的硬件建设。目前，区法制办核编为4人，现在编4人。其中正职1人，副职1人，法制专干2人。法律本科文化程度2人，大专2人；办公条件宽敞，并已配备电脑办公。

　　区政府严格执行行政复议各项规定，不断规范行政复议程序，严把行政复议案件的受理、审理和文书关，并始终遵循正当、公正、及时和便民的原则，认真负责，切实履行法定复议职责。在具体办理行政复议案件时着重抓了“四关四环节”。一是受理关。申请人提交复议申请后，首先对申请书进行审查，看是否在法定期限内，是否具备申请主体资格，是否属于受理范围，有关手续是否完备等。若全部符合复议法要求，即按规定受理，向被申请人投递申请书副本，并告知按时限提出答辩。二是审核关。即根据申请人提出的复议请求和事项，对被申请人提交的答辩意见和证据材料进行认真审查，具体核对，依法分析其客观性、公道性，并对执法主体单位的办案程序、法律文书等进行审查。三是调查关，即对双方提出的理由和证据进行调查、核实，必要时组织办案职员深进现场和实地，做进一步取证或重新调查工作。四是决定关。经过上述程序后，再经区政府行政复议委员会集体讨论研究，最后作出行政复议决定，并按时投递申请人和被申请人。在重点把好以上“四关”的同时，为完善监视机制，避免凭经验办案，法制办还坚持严格抓好“四环节”，即办案程序环节，适用法律环节，事实证据环节和裁量幅度环节。确实做到事实清楚，证据充分，适用法律、法规正确，处理程序正当，裁量幅度适当。决不将就某些部分和个别人情关系而委曲作出维持原具体行政行为的复议决定。公民闰永明不服区环卫局罚款0 0 0元的行政处罚决定而申请行政复议，经法制办工作职员认真查找法律依据并到现场实地查看，最后作出了依法撤销区环卫局原具体行政行为的复议决定。

　　在参加案件应诉时，区政府法制办克服人手少，案件多的实际困难，较好地履行了应诉职责，并在多数纠纷发生时间久，知情职员已退休、调走，证据缺乏的情况下，法制办主动出面积极同诉讼对方协调，并召集有关部分认真分析案情，多方查找证据，从而使应诉案件获得了胜诉，最大限度地挽回了经济损失。如行政治理相对人赵惠民与其兄赵毅民，为宅基地使用权发生纠份，为化解矛盾，经赵毅民申请，1994年5月，区土地局经报请区政府作出了七政土发[1994]03号处理决定，并由区政府法制局备案进行审查，决定下达后，赵惠民不服，先后通过行政复议、起诉、上诉、申诉、抗诉、发回重审等多种渠道进行抗辩，区法院、市中院前后共下达行政判决书5份。2004年3月15日，当事人赵惠民再次以“区政府94年的行政处理决定侵犯其土地使用权”为由，向兰州市中级人民法院提起行政诉讼，7月30日上午，中院重新公然审理此案，区政府法制办出庭应诉；8月13日中院下达裁定，依法驳回了原告赵惠民的诉讼请求，区政府依法取得了胜诉。

　　3、创新机制，加强监视
